1. Purpose

zkDraw is drawing software for computers, made for comics, sold on zkdraw.com by subscription or as a one-time purchase. These terms govern the trial, the subscription, the one-time purchase and the use of the software between you and the publisher of zkDraw, presented in the legal notice.

2. Your account

You need an account to use zkDraw. Give a valid email address and keep your password to yourself: you are responsible for what is done with your account. The account and the subscription are personal.

3. Free trial

The trial lasts 14 days from the confirmation of your email address. It is free, with no card and no commitment, and ends on its own: nothing is charged unless you subscribe.

4. Plans and prices

Three plans: a monthly subscription at CHF 4.90 per month, a yearly subscription at CHF 39.00 per year, and a one-time purchase at CHF 89.00, paid once. The price that applies is the one shown on the Pricing page when you subscribe or buy. Every feature is included, with no paid extras.

5. One-time purchase

The one-time purchase is paid once and never renews. It gives you, for good, the use of zkDraw version 1 and of all its updates (versions 1.x), on the terms of the licence to use below. A later major version (version 2 or beyond), if one is published, is not included: it may be offered to you at a reduced upgrade price. Online backup is not included either: it can be added as a paid monthly option (see “Online backup”). As with a subscription, zkDraw checks your licence online at least every 30 days.

6. Payment and renewal

You pay by card, through our payment provider. A subscription is paid at the start of each period and renews automatically, the monthly one every month and the yearly one every year, until you cancel it. The one-time purchase is paid once, when you buy it, and never renews. We neither see nor keep your card numbers.

7. Price changes

Prices may change. A yearly subscription keeps its price until its next renewal; a monthly subscription moves to the new price the following month. We tell you by email at least 30 days before, and you can cancel in the meantime. A one-time purchase already paid is not affected: you owe nothing more for version 1.

8. Cancellation

You can cancel a subscription at any time from your account. It is then no longer renewed and stays active until the end of the period already paid. A period that has started is not refunded pro rata. A one-time purchase has nothing to cancel, since it never renews.

9. Right of withdrawal and refunds

zkDraw is digital content supplied immediately. If you live in the European Union, you agree at purchase that access starts right away, and you acknowledge that you thereby lose your 14-day right of withdrawal. Apart from that, a refund remains possible at our discretion: write to us from the Contact page.

10. Licence to use

During the trial, during the subscription or, with a one-time purchase, for good, you have the personal, non-transferable right to use zkDraw on up to 3 computers linked to your account. The software checks your licence when it is online, then works for up to 30 days without a network. You may not resell, lend or share your access.

11. Your drawings

Your projects are .zkd files saved on your own disk. They stay yours: we get no rights over what you draw and we don't see your files unless you choose online backup. After your subscription ends, you can still open and export them; only drawing needs an active subscription. Remember to keep backup copies.

12. Online backup

Online backup saves your projects on zkdraw.com. It is included with the trial and with the monthly and yearly subscriptions. With the one-time purchase, it can be added as an option at CHF 1.90 per month, paid at the start of each month and cancellable at any time; it then stays active until the end of the paid month.

Each account has 1 GB of space, counting every version kept. zkDraw keeps the last 10 versions of each project; a project moved to the trash counts in the space until it is permanently deleted, 30 days later.

Your files are stored encrypted in Switzerland. They stay yours: we don't open them, except at your request to solve a problem or when the law requires it.

When your subscription or option ends, zkDraw no longer sends new versions, but you can still view and download your projects for 90 days. We warn you by email 30 days before that period ends. On day 90, your online projects and all their versions are permanently deleted. If you renew before then, everything is kept.

Online backup adds to your own copies, it doesn't replace them: always keep your .zkd files on your computer and make your own backups. Within the limits of the law, we are not liable for the loss of a project kept only online.

13. Warranty and liability

We do our best for zkDraw to work well, but we give no warranty beyond what the law requires. Except in the case of intent or gross negligence, our liability is limited to the amount you paid in the last 12 months.

What we keep about you, and why, is described in the privacy policy.

15. Changes to these terms

These terms may change. If a change affects your current subscription, we tell you by email at least 30 days before it applies, and you can cancel in the meantime.

16. Applicable law and jurisdiction

These terms are governed by Swiss law. The place of jurisdiction is Geneva. If you are a consumer, you keep the protection given to you by the mandatory rules of your country of residence.
